1. Scope and Agreement

These Terms of Service ("Terms") govern access to and use of MonitUp's websites, applications, and related services (together, the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms. At signup, acceptance of these Terms is required. The Privacy Policy explains how personal data is handled and is available at /privacy-policy.

2. Eligibility and Account Registration

You must have authority to enter into these Terms for yourself or the organization you represent. You are responsible for providing accurate registration information and keeping it up to date.

3. Account Security

You are responsible for account credentials, access control, and all activity under your account. Notify MonitUp promptly at [email protected] if you suspect unauthorized access.

4. Subscriptions, Billing, Renewal, and Cancellation

Paid plans are billed on a recurring basis unless otherwise stated in your order flow or plan details. Subscriptions renew automatically unless canceled before the next billing cycle. Fees are non-refundable except where required by applicable law or expressly stated in writing.

You must provide valid and current billing information. MonitUp may suspend or limit service for failed or overdue payments.

5. Free Trial

MonitUp may offer free trials. Trial duration, scope, and eligibility are defined in the offer shown at signup. Unless canceled before trial end, the account may move to a paid plan according to the selected billing setup.

6. Acceptable Use

You agree not to misuse the Service, including by attempting unauthorized access, interfering with service operation, distributing malware, infringing rights, or violating applicable law.

7. Monitoring and Lawful Use Responsibilities

You are solely responsible for configuring and using MonitUp lawfully in your organization. This includes:

  • providing required notices to employees, contractors, and end users;
  • obtaining required permissions, approvals, and legal basis under applicable law;
  • adopting and applying your own internal policies for monitoring and workplace data use;
  • configuring retention, access, and settings in line with your legal obligations.

Use of MonitUp does not by itself make a customer compliant with employment, privacy, or data protection laws.

8. Customer Responsibilities

You are responsible for your content, your users, your internal governance, and your instructions regarding data processed through the Service. You must ensure your use does not violate rights of third parties.

9. Privacy and Data Protection

MonitUp's data practices are described in the Privacy Policy at /privacy-policy. For business and enterprise customers, a separate data processing agreement (DPA) may apply where required.

10. On-Premise Deployments

For on-premise deployments, the customer controls its own environment, infrastructure, user permissions, and data access. MonitUp provides software and support.

MonitUp does not have continuous, automatic, or standing access to customer on-premise environments. Any support access is limited to what the customer explicitly enables and authorizes.

11. Service Availability and Changes

MonitUp may update, improve, or modify Service features over time. We may perform maintenance and may suspend access when required for security, legal, or operational reasons.

12. Intellectual Property

MonitUp and its licensors own all rights in the Service, including software, branding, and related materials. These Terms grant a limited right to use the Service during an active subscription in accordance with these Terms.

13. Disclaimer

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. MonitUp disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, MonitUp is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data.

To the maximum extent permitted by law, MonitUp's total liability for claims arising out of or related to the Service will not exceed the fees paid by you to MonitUp for the Service during the 12 months before the event giving rise to the claim.

15. Suspension and Termination

MonitUp may suspend or terminate access for material breach, legal risk, abuse, or security concerns. You may stop using the Service and cancel your subscription according to your plan terms.

16. Governing Law

These Terms are governed by the laws of Turkey, excluding conflict-of-law rules, unless mandatory local law requires otherwise.

17. Changes to These Terms

MonitUp may update these Terms from time to time. Material updates will be posted on this page with an updated "Last updated" date and version. Continued use after updates become effective means you accept the revised Terms.

These Terms do not include mandatory marketing or newsletter consent. Marketing preferences, where offered, are separate and optional.
